Subrogation
 

The definition of Subrogation is as follows;

In employee benefit plans, the right of the plan sponsor or insurance company to recoup benefits paid for plan participants, if the payments of the plan are the responsibility of a third party or results from the fault of another individual.

When a claim is received at Midwest Security and the diagnosis on the claim could result in a subrogation claim, a letter is sent to the plan participant asking for information concerning the accident (injury or sickness). The information we ask is how did the accident happen, where did the accident happen, when did the accident happen and if additional information such as addresses or insurance information is known of any third parties involved.

When the completed information is received in our office it is reviewed for possible third party liability. If it is determined that a third party may be involved, our subrogation specialist will work with the third party in an attempt to reach a settlement. You or your dependents have a right to recover damages from a responsible or liable party and the plan will be subrogated to recover those damages. The plan's Right of Subrogation to full recovery may be made from the responsible or liable party, which can include but is not limited to, insurance covering another responsible or liable party, you or your dependent's own insured or uninsured motorist coverage and worker"s compensation coverage.

In some cases, claims are not payable under the benefits plan while subrogation is being pursued. Please refer to your benefits plan for more detailed information.
